These SMS/Text Messaging Terms & Conditions ("SMS Terms") are provided by Calance LLC ("Calance," "we," "us," or "our") and govern your participation in our SMS and text messaging programs. By opting in to receive SMS messages from Calance, you agree to these SMS Terms. These SMS Terms supplement our Privacy Policy at https://www.calanceus.com/privacy-policy

1. Program Description: IT Staffing & Recruitment

Calance uses SMS messaging exclusively for IT Staffing & Recruitment purposes. Our SMS program supports:

  • Recruiter-candidate outreach about open IT roles, including roles the candidate has not previously applied to (provided the candidate has generally opted in to receive job opportunity messages)
  • Job opportunity notifications about specific IT openings matching your profile and qualifications, across contract, contract-to-hire, direct placement, and project-based staffing positions
  • Application status updates and interview scheduling
  • Interview confirmations and reminders
  • Customer service and support communications for active staffing engagements

2. Opt-In & Consent

You will only receive SMS messages from Calance if you have expressly opted in. Consent may be provided through any of the following methods, as detailed in Section 3 of our Privacy Policy:

  • Submitting your mobile number through our web form, which explicitly references SMS consent
  • Providing written consent on a Calance paper or digital intake form
  • Giving recorded verbal consent to a Calance recruiter, with the time, date, and program documented

By providing your mobile number and opting in, you confirm that you are the authorized user of the mobile number provided and that you agree to these SMS Terms and our Privacy Policy.

3. Message Frequency & Rates

Message frequency varies based on job opportunities and your stage of engagement. For recruitment outreach, you can typically expect 1 to 4 messages per month. Frequency may be higher during active interview processes or active staffing engagements.

Message and data rates may apply. Please check with your mobile carrier for details on your plan's rates.

Consent to receive SMS messages is not a condition of employment, applying for any job, or any other transaction with Calance.

4. Automated Technology

Messages may be sent using an automatic telephone dialing system (ATDS) or other automated technology. By opting in, you consent to receive messages sent via automated methods.

5. Opt-Out Instructions

You may opt out of Calance SMS messages at any time:

  • Reply STOP to any message you receive
  • Upon receipt of your STOP request, you will receive one final confirmation message, and you will be removed from that SMS program immediately
  • To re-subscribe, you must complete a new opt-in through one of the methods described in Section 2

For complete information on how we collect, use, protect, and limit sharing of your mobile number and SMS opt-in/consent data, please see Section 3 (SMS / Text Messaging) of our Privacy Policy. Key commitments include:

  • Your mobile information will not be sold or shared with third parties for promotional or marketing purposes

  • SMS opt-in and consent data is collected and maintained separately from other personal information

  • SMS consent data is excluded from general data sharing arrangements and is only shared with service providers who assist in delivering the messages (such as platform providers and carriers)

8. Participant Requirements

By participating in our SMS program, you agree to:

  • Provide accurate and current information, including a valid mobile number for which you are the authorized user

  • Promptly notify Calance if your mobile number changes or is deactivated

  • Not use the SMS program for any unlawful, harassing, or abusive purpose

9. Limitation of Liability

Calance is not responsible for delays, failures to deliver, or any costs incurred due to:

  • Carrier network issues, outages, or congestion

  • Mobile device settings, compatibility issues, or number changes

  • Carrier blocking or filtering of messages

  • Your failure to notify us of a change in your mobile number

Messages are provided on an "as is" basis. To the fullest extent permitted by applicable law, Calance's total liability arising out of or related to the SMS program is limited to the amount you have paid to Calance (if any) in the twelve (12) months immediately preceding the event giving rise to the claim.

10. Modifications to These Terms

We may update these SMS Terms or modify our SMS program at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued participation in the SMS program after changes are posted constitutes your acceptance of the updated terms. We encourage you to review these SMS Terms and our Privacy Policy periodically.

11. Governing Law

These SMS Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these SMS Terms shall be resolved in the courts of competent jurisdiction in California.
